Terms of Service
Last updated:
1. Acceptance of Terms
By downloading, installing, or using the PocketNode application or website at pocketnode.org ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Description of Service
PocketNode provides a peer-to-peer (P2P) computing marketplace. The Service allows:
- Providers to share idle device computing resources and earn PNODE tokens.
- Customers to purchase computing tasks processed by the network.
- Investors to purchase a proportional share in platform revenue.
- Validators, Advertisers, and Agents to participate in other network roles as described in the app.
PocketNode acts as the marketplace operator and does not guarantee specific task volumes, token values, or earnings amounts.
3. Eligibility
You must be at least 18 years old to use PocketNode. By using the Service, you confirm that you are 18 or older and have the legal capacity to enter into these Terms in your jurisdiction. You are solely responsible for ensuring that your use of PocketNode complies with all applicable laws and regulations in your country of residence.
4. Account Responsibilities
You are responsible for maintaining the security of your account credentials, including your password and connected wallet private keys. PocketNode will never ask for your private key or seed phrase.
You must notify us immediately at [email protected] if you suspect unauthorized access to your account. PocketNode is not liable for losses resulting from compromised account credentials.
5. PNODE Token — Utility Token Disclosure
The PNODE token is a utility token used exclusively within the PocketNode network to pay for computing services, reward Providers, and facilitate platform transactions. PNODE is not a security, investment product, or financial instrument.
Holding or earning PNODE tokens does not represent ownership in PocketNode, a claim on company assets, or a right to dividends. The value of PNODE tokens may fluctuate significantly and may lose value entirely. Nothing in these Terms or on our platform constitutes investment advice.
6. Income Disclaimer
Any earnings, income figures, or financial estimates presented by PocketNode — including on our website, in the app, or in marketing materials — are estimates only and are not guaranteed. Actual earnings depend on multiple factors including, but not limited to:
- Your device's computing specifications and availability
- Current network demand for computing tasks
- Your activity level and uptime as a Provider
- PNODE token market value at the time of conversion
- Network fees and platform commission rates
Past earnings or performance figures are not a guarantee or reliable indicator of future results. You should not make financial decisions based solely on projected income estimates from PocketNode.
7. Prohibited Uses
You may not use PocketNode to:
- Process, store, or transmit illegal content, including content that violates copyright, privacy, or criminal laws.
- Conduct cryptocurrency mining not authorized by the PocketNode protocol.
- Reverse engineer, decompile, or disassemble the PocketNode application.
- Scrape, crawl, or extract data from PocketNode infrastructure without written permission.
- Attempt to gain unauthorized access to other users' accounts, devices, or data.
- Abuse, harass, or defraud other network participants.
- Use the platform for any activity that violates applicable laws in your jurisdiction.
- Manipulate network metrics, Validator scores, or earnings calculations through artificial means.
Violation of these prohibitions may result in immediate account suspension without refund.
8. Intellectual Property
The PocketNode name, logo, application code, and all associated materials are the intellectual property of PocketNode. You are granted a limited, non-exclusive, non-transferable license to use the app for its intended purpose. No ownership rights are transferred to you.
9. Limitation of Liability
To the fullest extent permitted by applicable law, PocketNode and its affiliates, officers, and employees are not liable for:
- Fluctuations in PNODE token value or network earnings.
- Loss of earnings due to network downtime, maintenance, or changes to reward rates.
- Device damage resulting from normal use of the PocketNode application.
- Losses resulting from user error, compromised account credentials, or blockchain transaction failures.
- Indirect, incidental, or consequential damages of any kind.
Our total liability for any claim arising out of these Terms shall not exceed the total PNODE token value you earned through the platform in the 3 months preceding the claim.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.
11. Termination
You may close your account at any time by contacting [email protected]. PocketNode reserves the right to suspend or terminate accounts that violate these Terms, with or without prior notice. Upon termination, any accrued PNODE earnings that have not yet been withdrawn may be forfeited if the termination was due to a violation of these Terms.
12. Governing Law and Disputes
These Terms are governed by and construed in accordance with internationally recognized principles of commercial law. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be finally resolved by arbitration administered by the Singapore International Arbitration Centre (SIAC) under the SIAC Rules, which are deemed incorporated herein. The seat of arbitration shall be Singapore. The language of arbitration shall be English. The arbitral award shall be final and binding.
You agree that any claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class action.
13. Force Majeure
PocketNode shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to: acts of God, war, terrorism, civil unrest, strikes, governmental actions, internet outages, blockchain network failures, smart contract exploits by third parties, exchange failures, or pandemic events. During a force majeure event, PocketNode's obligations under these Terms are suspended for the duration of the event.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible, and the remaining provisions shall continue in full force and effect.
